Enduring Power of Attorney (EPOA)

Sometimes, a person can’t make decisions when needed. You could be away or not be able to make decisions as a result of a disability or be too ill to make decisions.

An EPOA is an important legal document where you (the Principal) appoint some else (the Attorney) giving your Attorney the power to make personal or financial decisions on your behalf.

There are criteria that you must meet before you can make an EPOA. You must be an adult and you must have capacity to make decisions. Having “capacity to make decisions” means that you can understand the nature and effect of a decision, freely and voluntarily make those decisions and communicate the decisions in some way.

It is also a requirement that you must understand the nature and effect of an EPOA and you must understand the consequences of preparing an EPOA.
